1. Acceptance of Terms

By accessing or using Florida Gig Fleet's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

Florida Gig Fleet ("we," "us," or "our") provides vehicle rental services specifically designed for rideshare and gig economy workers. These Terms govern your use of our website, mobile applications, and rental services.

2. Eligibility Requirements

To rent a vehicle from Florida Gig Fleet, you must:

  • Be at least 21 years of age
  • Possess a valid U.S. driver's license for at least one year
  • Have an active rideshare or delivery platform account (Uber, Lyft, DoorDash, etc.)
  • Pass our background check and driving record review
  • Provide valid insurance documentation or purchase our insurance coverage
  • Have a valid payment method on file

3. Rental Agreement

3.1 Rental Period

Rental agreements are available on a weekly or monthly basis. The rental period begins when you take possession of the vehicle and ends when you return it to our designated location or as specified in your rental agreement.

3.2 Payment Terms

  • Weekly rentals: Payment due at the beginning of each rental week
  • Monthly rentals: Payment due on the 1st of each month
  • Late payments may result in late fees and/or suspension of rental privileges
  • A security deposit may be required based on your approval status

3.3 Vehicle Use

Rented vehicles may ONLY be used for:

  • Rideshare services (Uber, Lyft, etc.)
  • Food and package delivery services (DoorDash, Uber Eats, Amazon Flex, etc.)
  • Other approved gig economy work
  • Personal commuting directly related to gig work

3.4 Prohibited Uses

You may NOT use the vehicle for:

  • Illegal activities of any kind
  • Racing, off-road driving, or reckless driving
  • Transporting hazardous materials
  • Subleasing or allowing unauthorized drivers to operate the vehicle
  • Leaving the state of Florida without prior written approval
  • Smoking or vaping inside the vehicle

4. Insurance and Liability

4.1 Insurance Coverage

All rental vehicles are covered by our commercial insurance policy. You are responsible for:

  • Any deductible amounts in case of accidents
  • Damage not covered by insurance
  • Violations or fines incurred during your rental period

4.2 Your Responsibilities

  • Report any accidents or damage immediately (within 24 hours)
  • Maintain the vehicle in clean condition
  • Complete all required maintenance as instructed
  • Follow all traffic laws and regulations

5. Maintenance and Repairs

We provide comprehensive maintenance support:

  • All routine maintenance is covered by Florida Gig Fleet
  • You must report any mechanical issues immediately
  • Emergency repairs must be pre-approved unless safety-critical
  • You are responsible for damage caused by neglect or misuse
  • Regular oil changes and tire rotations are required as scheduled

6. Termination

6.1 By You

You may terminate your rental agreement with 7 days written notice. Early termination fees may apply.

6.2 By Us

We reserve the right to terminate your rental agreement immediately if:

  • You violate these Terms of Service
  • You fail to make timely payments
  • You engage in prohibited uses of the vehicle
  • Your driver's license or insurance becomes invalid
  • You provide false or misleading information

7. Fees and Charges

  • Late Payment Fee: $25 per day after grace period
  • Cleaning Fee: $50-$200 depending on condition
  • Smoking Fee: $250 per occurrence
  • Traffic Violations: Cost of fine plus $35 administrative fee
  • Fuel Policy: Return vehicle with same fuel level or pay refueling fee
  • Excessive Mileage: Charges may apply for excessive use beyond agreed limits

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • We are not liable for indirect, incidental, or consequential damages
  • Our total liability is limited to the amount you paid for rental services
  • We are not responsible for loss of earnings or business interruption
  • You assume all risk for your use of the vehicle in gig economy activities

9. Indemnification

You agree to indemnify and hold harmless Florida Gig Fleet from any claims, damages, or expenses arising from:

  • Your violation of these Terms
  • Your use of the rental vehicle
  • Your violation of any laws or regulations
  • Claims by third parties related to your use of the vehicle

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

10.2 Arbitration

Any disputes arising from these Terms shall be resolved through binding arbitration in Tampa, Florida, in accordance with the rules of the American Arbitration Association.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through our website. Your continued use of our services after changes constitutes acceptance of the modified Terms.
